At Ing. Gert Blühberger, Arbeiterstrandbadstr. 21/16, 1210 Vienna (hereinafter referred to as "Blühberger" or "we") we take your privacy very seriously. This privacy policy covers the use of the following websites:

Our privacy policy describes the types of personal data we collect in connection with the services offered on the afore-mentioned websites, the purposes for which we collect personal data and the third parties with whom we share information. In addition, it provides you with information about your rights in relation to personal data and how you can contact us. 

Blühberger is the data controller responsible for collecting and using your personal data in connection with the services offered on the afore-mentioned websites.
Blühberger is further obliged to secrecy in accordance with Article 39 of the Austrian Accountancy Act (BibuG).

 

1. PERSONAL DATA

Personal data means any information relating to an identified or identifiable natural person. We collect personal data when you contact us in connection with the afore-mentioned websites or register on the chain transaction calculator.

We use your personal data in conformity with the terms of use or the usage contract, if you are already a customer of the chain transaction calculator. However, in some cases, you will not be able to take advantage of certain services if you do not provide us with your personal data.

1.1 Data we require to execute the agreement and data collected based on our legitimate interests

To implement the agreement, we collect the following types of personal data (when you register on the chain transaction calculator or to process your request) and/or based on our legitimate interests:

  • Salutation,
  • Title,
  • Name,
  • Surname,
  • Name of the company or firm,
  • Address including postcode, city and country,
  • Email,
  • Telephone number,
  • VAT number
  • Password,
  • Your internal order number, if applicable
  • Your billing email address, if applicable
  • If applicable, further e-mail addresses that you provide us with (e.g. for reminders and additional accesses).

In addition, we process any personal data that you submit to us during when sending us a request.

1.2 Data we collect automatically

We may use cookies to collect the following data automatically. A "cookie" is a text file that is stored on your computer. We collect the following data automatically:

  • We do not collect any personal data on the websites www.chain-transaction.de and www.triangular-transaction.de that could be automatically traced back to you. However, via the links on theses websites you can access the website www.chaintransaction-calculator.de, which is specified in the following bullet point.
  • If you use the website www.chaintransaction-calculator.de without registration, we will not collect any personal data that could be used to identify you. Only session cookies are used, which do not contain any personal data and are automatically deleted after the browser is closed.
  • If you register at www.chaintransaction-calculator.de, we store an identification cookie (as a result of your authorisation to access the chain transaction calculator) on your computer, which are used to collect the following data upon registration and after you log in:
      • The IP address of the computer or mobile device,
      • The operating system,
      • The browser type,
      • Settings data (screen resolution, browser extensions and plugins, fonts, language and time zone settings)
      • The date and time of access
      • Visited websites
      • If applicable, stored replacement countries when using the personalized print version.
    When you log in again, this data is collected again and the data stored in the cookie is read and saved.

2. HOW WE USE THE COLLECTED PERSONAL DATA

We use the personal data specified under Section 1 for the following purposes:

2.1 Execution of the contract

We process your data, as specified under Section 1.1, to fulfil our obligations under the agreement to which you are party or to execute the pre-contractual measures that have been carried out based on your request. This includes the following cases:

  • Customer inquiries: If you send us an enquiry, and we process the data to respond and communicate with you,
  • Registration on the chain transaction calculator: We process your data and send you a so-called activation email as a pre-contractual measure. This activation email contains a link to activate your account, and at the same time informs you about the stored master data,
  • Activation of your account on the chain transaction calculator: We process your data and send you an invoice for the ordered licence.
  • Subsequent invoices (e.g. licence renewals, contract renewals, invoice corrections): we process your data and send you an invoice,
  • Forgotten password feature: When enabled, you will receive an automated email with a link to reset your password,
  • The sending of legal information in connection with the user agreement, the privacy policy and / or the cookie policy.

2.2 Legitimate interests

We process your data described in Section 1.1 based on our legitimate interests. Processing for the following purposes qualifies as legitimate:

  • Internal administrative purposes,
  • Direct marketing of licence renewals (these emails contain an opt-out notice),
  • Sending the latest legal information about chain transactions (these emails contain an opt-out notice),
  • Dunning in case of late payment,
  • Sending warnings of alleged licence infringements,
  • The establishment, exercise or defence of legal claims.

We process your data described in Section 1.2 based on our legitimate interests. Processing for the following purposes qualifies as legitimate:

  • Use of paid access to the chain transaction calculator: We process the "fingerprint data" specified in Section 1.2 to check compliance with the terms of use (in particular, to check whether access data for single-user licences are only used on a single computer in accordance with the user agreement),

2.3 Cookies

Your personal data under Sections 1.2 will be collected automatically. For more detailed information on how cookies are used to collect and use your personal data, please refer to our cookie policy.

2.4 Recipients of personal data

No personal data is transferred to a third country. We may forward personal data in the following cases or to the following recipient groups:

  • Transmission of the (non-Austrian) VAT number to the tax office in the EC-Sales-List,
  • If required to disclose data by law,
  • If you fail to meet your contractual obligations, we may transfer your personal data to the following recipient groups: collection agencies, legal practitioners and courts. In this case, you will receive a message from us in advance to give you the opportunity to comment.

 

3. YOUR RIGHTS

You are entitled to request information about the personal data we store about you. You have the right, within a one-month period which may be extended for a further two months, to obtain (i) a confirmation of the processing of your personal data, (ii) information about the processing of the data and (iii) a copy of the processed personal data.

You also have the right to have your personal data corrected if it is incorrect or incomplete.

You have the right to have your personal data deleted if the processing is in violation of the applicable data protection laws and regulations, in particular, if you have revoked your previously-given consent or filed an objection for legitimate reasons.

Furthermore, you have the right to raise an objection with us if the legal basis for data processing constitutes an overriding legitimate interest and we cannot prove that our interests outweigh yours.

You also have the right to file a complaint with the relevant data protection authority.

You have the right to exclude your personal data from further processing, if you exercise your right of correction or objection and we have not yet made a decision on this (right to restriction of processing).

You have the right to data portability, i.e. the right to receive the personal data concerning you in a structured, commonly-used and machine-readable format, and the right to transmit this data to another responsible person specified by you, provided that the requirements of Article 20 GDPR have been met.

4. STORAGE OF DATA

If you register on the chain transaction calculator website but fail to click on the activation link in the activation email (i.e. you do not place an order), we will store the data categories specified in Section 1.1 until two working days after registration, as part of the performance of our pre-contractual measures. This data is deleted automatically at the end of this period.

When a customer places an order (e.g. by clicking on the activation link in the activation email) we store, as part of the contract execution, the data specified in Sections 1.1 and 1.2, business correspondence, invoices and payment data for periods that comply with the following retention and limitation periods:

  • Retention period under Article 132 (1) of the Austrian Federal Fiscal Code (BAO) (this concerns mainly invoice and payment data): 7 to 10 years
  • Retention period under Article 212 or the Austrian Commercial Code (UGB) (this also covers business correspondence): 7 years
  • Right to compensation under Article 1489 of the Austrian Civil Code (ABGB) (this applies also to the log files specified in Section 1.2 and the data specified in Section 1.1): 3 to 30 years
